Creative Kids Global S.R.L., reserves the right to delay or cancel deliveries of ordered products if they cannot be met for reasons independent of Creative Kids Global S.R.L., including but not limited to: Fires, explosions, floods, extreme weather conditions, epidemics, strikes, government measures , wars, acts of terrorism, protests, riots, civil unrest or other force majeure obstacles in accordance with the customs of Romanian law.

*COMMERCIAL PRODUCTS

The products sold through the website www.creativekidsglobal.com are new products and are accompanied by an invoice at the time of delivery, in accordance with the legislation in force. The products are offered in accordance with the provisions of this contract and within the limits of available stock. Creative Kids Global S.R.L., reserves the right not to fulfill a particular order if the product in question is no longer in stock in the store or for reasons beyond the company's control.

*The price

The prices displayed on the website are inclusive of VAT.

The purchase price printed on the invoice is the same as that displayed on the Website at the time of the order, less, in the case of discounts for member customers, the final value being that indicated in the confirmation email. We reserve the right to change the price of products without prior notice. We accept responsibility for ensuring that the value of the order does not change after confirmation by confirmation email to the address you provided at registration.

We make every effort to display the color of the products shown on the website as accurately as possible. However, the color you see will depend on the monitor you are using and its settings. * DELIVERY AND PAYMENT

Confirmation of an order implies full acceptance of the terms and conditions set out in this document. Acceptance of the order by Creative Kids Global S.R.L., is considered complete when an electronic confirmation (e-mail) is received from the company to the buyer, stating that the order has been reviewed and is about to enter the delivery process, requiring confirmation of receipt by the buyer. The confirmation is sent electronically (e-mail) after the order has been prepared.

The products ordered must be paid for in full, otherwise delivery will not take place.

Transportation costs are borne by the customer and there is no possibility of deliveries being made against payment to the recipient or via courier companies other than those with which the company cooperates.

If the customer later requests changes to the order in writing by e-mail to info@creativekidsglobal.com, the delivery period will be 15 working days from the date of the last intervention in the initial order. We also reserve the right to cancel orders where more than two changes are requested at the time of ordering.

After two unsuccessful delivery attempts by the partner courier company to you, your order will be deemed received, canceled and this contract terminated.

We reserve the right to stop sending orders to people who have a maximum of two orders whose delivery could not be successfully completed within one month.

If the buyer is not found at the address specified in the order within the specified period, the courier will return again after contacting the buyer. If the buyer is still not found at the delivery address on the second delivery attempt, the order will be canceled and this contract will be considered terminated.

Creative Kids Global S.R.L., is not responsible for possible delays due to the courier company and does not take responsibility for any problems due to the product delivery process.

Creative Kids Global S.R.L., reserves the right to postpone all these terms and conditions for a certain period of time after prior notification to potential consumers by electronic means.

* COMMUNICATION AND COMPLAINTS

Users may be contacted by post, email, text message (SMS), alerts, WhatsApp, or telephone, or by posting information on the website.

Creative Kids Global S.R.L., is responsible for the quality of the products sold during the warranty period. The warranty conditions granted to consumers comply with Law 449/2003 and Legislative Decree 21/1992.

Complaints must be submitted in accordance with the following instructions, otherwise they will not be considered:

- Complaints shall be submitted within a maximum of 48 hours after receipt of the order by the buyer

- the complaint must be accompanied by specific data relating to the order number, the number of the tax document, the number of packages, the mode of transportation, the reason for the complaint, the causes that are said to have led to the complaint, etc. Customer claims.

Creative Kids Global S.R.L., will respond to the complaint within max. 10 working days from receipt.

 In order to resolve the complaint, Creative Kids Global S.R.L., will decide to:

* repair the goods complained about at its own expense;

* Pay the equivalent value of the products;

* Reject the complaint;

No complaint will be considered if the goods have been altered or tampered with in any way. This list is not exhaustive.

The customer is not entitled to any compensation regarding the quality or quantity of the goods purchased from Creative Kids Global S.R.L., if they have not followed the above complaints procedure.

Applicable laws require that some of the notices we send you be in writing. By using our website, you agree to communicate with us primarily by electronic means. For contractual reasons, you consent to these electronic means of communication and agree that all contracts, notices, information and other communications we send to you will comply with the legal requirement that such communications be in writing, unless applicable law does not permit this agreement.

*ASSIGNMENT OF RIGHTS

Except as otherwise provided by applicable law, you may not transfer, assign or otherwise dispose of any of your rights or obligations, including but not limited to payment obligations, without our prior written consent. We may at any time transfer, assign, subcontract or otherwise dispose of the operation of the Website or any part of it or any rights or obligations arising therefrom, in which case we shall not be relieved of any responsibility for the performance of our obligations to you, but the transferee shall be a joint and several debtor in such relations.

*RIGHT OF RETURN

The consumer may return a product or cancel a service within 14 calendar days of placing the order without giving any reason and without incurring any costs other than those for delivery and return.

Thus, according to GEO No. 34/2014, the deadline for returning a product or canceling a service is 14 days:

- The day on which the consumer physically takes possession of the product or receives the service.

To give notice of the return, you must contact us at info@creativekidsglobal.com or complete the online form on the website. Forms completed after this 14-day period will not be considered. Upon registration of the return request, a special sticker will be issued in the customer account.

We recommend that you indicate the order number or invoice number and the bank account number (including the owner's name) to which the refund should be made. According to the law, a clear declaration of your withdrawal from the respective purchase contract is required. The condition for the acceptance of the returned products is that they are in the same condition in which they were delivered (original packaging, attached labels, brand emblems, composition emblems and accompanying documents).

The buyer is obliged to inform Creative Kids Global S.R.L., within 15 calendar days from the date of receipt of the products, of the intention to return them by registering a return request in the customer account. The cost of returning the products shall be borne by the buyer.

In addition, the buyer is obliged to ensure that the returned products are shipped within a maximum of 5 calendar days from the submission of the return request, including the transportation time to Creative Kids Global S.R.L.. Packages that do not meet the above requirements will be rejected.

After the withdrawal from the contract, we will refund the payment made for the purchase of the product, excluding the costs of delivery and packaging - if you have also chosen this option. The refund will be made no later than 14 calendar days from the date on which the product is returned to the operator and its authenticity is confirmed, the purchase invoice, payment and labels are intact. The refund will be made by bank transfer.

- If the buyer opts for the refund by bank transfer, he/she is obliged to indicate the IBAN account number, the name of the owner and the CNP.

We reserve the right to refuse a refund if:

- This is requested no later than 14 days after receipt of the last product - if the order is delivered in parts;

- the packaging is damaged

- labels are damaged or replaced;

- the packaging shows signs of use, scratches and dents;

- The return costs are not borne by the consumer.

The direct costs related to the return of the products are at the expense of the buyer and may depend on the size and weight of the returned products.

In addition, the consumer is responsible for

- the additional costs associated with a delivery method other than the standard delivery method indicated by the professional, if this option exists

- depreciation of the returned products resulting from their handling.

Pursuant to GEO 34/2014, art. 16, letter e, Creative Kids Global S.R.L., reserves the right not to accept the return of products that cannot be returned due to their nature or that may deteriorate or damage quickly, such as underwear, swimwear and/or cosmetic products.

With regard to the transfer of risk, the consumer assumes the risk of loss or damage to the products when taking physical possession of them. Exceptionally, the risk is transferred to the consumer when the products are delivered to the carrier chosen by the consumer.

The invoice accompanying the delivery shall govern any claims or returns. This guarantee certificate grants all the rights guaranteed by law (Law 449/2003, O.G. 21/1992, republished). In the event of a justified and legal claim, Creative Kids Global S.R.L. may replace the product if it is in stock.

In the event of unavailability, the customer will be refunded the purchase price within the legally stipulated period, calculated from receipt of the written complaint and the product in question. Compliance with the stated conditions is required for the guarantee to be granted. The guarantee expires if the original invoice, the purchase labels are missing or damaged.
